Welcome to the Vocal Nest legal information page. Please read the following policies carefully. By using Vocal Nest, you agree to the terms outlined below. Vocal Nest is operated by Park Creative Limited, a company incorporated in New Zealand.
1. Video Policy
1.1 Video Collection & Consent
Vocal Nest is a platform designed to collect video testimonials from willing participants. Every video collected through the platform is governed by the following principles:
- Informed Consent: Before submitting a video, every respondent is required to provide explicit consent, acknowledging that their recording may be used for promotional, marketing, or testimonial purposes by the campaign creator.
- Voluntary Participation: Video submission is entirely voluntary. Respondents may choose not to record or to retake their response at any time before final submission.
- No Coercion: Campaign creators must not coerce, mislead, or pressure respondents into recording a testimonial.
1.2 Video Ownership
- Respondent Rights: Respondents retain the intellectual property rights to their likeness and spoken content. By submitting a video, they grant the campaign creator a non-exclusive, royalty-free licence to use the recording for the purposes stated in the consent form.
- Campaign Creator Rights: Campaign creators have the right to use, display, embed, and share submitted videos in accordance with the consent given by the respondent.
- Platform Rights: Vocal Nest does not claim ownership of any video content uploaded through the platform. Videos are stored solely for the purpose of delivering the service.
1.3 Video Storage & Retention
- Videos are stored securely using industry-standard encryption at rest and in transit.
- Campaign creators may delete individual video responses at any time from their dashboard.
- If a campaign is deleted, all associated video files are permanently removed within 30 days.
- Respondents may request deletion of their video by contacting the campaign creator directly or by emailing hello@parkcreative.nz.
1.4 Prohibited Video Content
The following types of content are strictly prohibited:
- Content that is defamatory, abusive, hateful, or discriminatory.
- Content that contains nudity, violence, or graphic material.
- Content that infringes on the intellectual property rights of any third party.
- Content that is illegal or promotes illegal activity.
Vocal Nest reserves the right to remove any content that violates these terms without prior notice.
2. Privacy Policy
This Privacy Policy has been prepared in accordance with the New Zealand Privacy Act 2020 and the Privacy Principles contained within it. We are committed to protecting your personal information and handling it responsibly.
2.1 Who We Are
Vocal Nest is operated by Park Creative Limited (the "Company"), a New Zealand company. We are the agency that collects and holds your personal information as described in this policy. Our contact details are listed in Section 6 below.
2.2 Information We Collect
We collect personal information only where it is necessary for the purposes of delivering and improving our service.
From Account Holders (Campaign Creators)

We collect this information directly from you at the time you provide it. In some cases, information may be collected indirectly โ for example, technical data such as device type and browser used may be collected automatically when you access the platform.
2.3 How We Use Your Information
Your information is used solely for:
- Providing and improving the Vocal Nest service.
- Authenticating your identity and managing your account.
- Sending transactional communications (e.g. invitations, notifications).
- Generating AI-powered video transcriptions for campaign creators.
- Complying with legal obligations under New Zealand law.
We do not sell, rent, or trade your personal information to third parties.
2.4 Data Sharing
We will not disclose your personal information to any other person or organisation except in the following circumstances:
- With your team members: If you are part of a Flock workspace, your display name and email may be visible to other team members within the same workspace.
- With campaign creators: Respondent data (name, email, job title, and video) is shared directly with the campaign creator who initiated the testimonial request.
- With service providers: We use trusted third-party technology providers to store and process data on our behalf. These providers are contractually required to handle personal information in accordance with the New Zealand Privacy Act 2020 and applicable data protection standards.
- When required by law: We may disclose information if required by a valid legal process, court order, or government request in accordance with New Zealand law.
2.5 Overseas Disclosure
Some of our technology service providers are based outside of New Zealand. As a result, personal information may be stored or processed in overseas data centres. Where this occurs, we take reasonable steps to ensure your information receives comparable protections to those required under the New Zealand Privacy Act 2020, including by selecting providers who comply with internationally recognised security and privacy standards.
2.6 Data Security
We take all reasonable steps to protect your personal information from loss, misuse, unauthorised access, modification, or disclosure:
- All data is transmitted using TLS/SSL encryption.
- Video files and all personal data are stored with server-side encryption at rest.
- Access to user data is protected by strict role-based access controls and security policies enforced at both the application and infrastructure levels.
- Access credentials are never shared and are subject to regular review.
2.7 Your Rights Under the New Zealand Privacy Act 2020
Under the Privacy Act 2020, you have the right to:
- Access your personal information: You may request a copy of the personal information we hold about you. We will respond within 20 working days as required by law.
- Correct your personal information: If you believe any information we hold about you is inaccurate, you may request that it be corrected.
- Request deletion: You may request that we delete your personal information, subject to any overriding legal obligations we may have to retain it.
- Complain to the Privacy Commissioner: If you believe we have breached the Privacy Act 2020, you have the right to make a complaint to the Office of the Privacy Commissioner at www.privacy.org.nz.

2.8 Cookies & Analytics
Vocal Nest uses minimal cookies for essential functionality:
- Session cookies: To maintain your authentication state while you are logged in.
- Preference cookies: To store your display preferences (e.g. light/dark mode).
We do not use any third-party tracking cookies or advertising trackers.
2.9 Children's Privacy
Vocal Nest is not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us immediately at hello@parkcreative.nz and we will take appropriate steps to delete that information.
2.10 Retention of Personal Information
We retain personal information only for as long as it is needed to fulfil the purpose for which it was collected, or as required by law. When personal information is no longer required, we take reasonable steps to destroy or de-identify it in a secure manner.
3. Terms of Use
3.1 Acceptable Use
By using Vocal Nest, you agree to:
- Use the platform only for lawful purposes.
- Not attempt to gain unauthorised access to any part of the service or any systems or networks connected to the service.
- Not upload or distribute malicious software, spam, or harmful content.
- Respect the privacy and rights of respondents and other users.
- Comply with all applicable New Zealand laws, including the Privacy Act 2020, the Fair Trading Act 1986, and the Films, Videos, and Publications Classification Act 1993.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
3.3 Intellectual Property
All content, trademarks, logos, and other intellectual property on the Vocal Nest platform (excluding user-submitted content) are owned by or licenced to Park Creative Limited. You may not reproduce, distribute, or create derivative works from this content without our express written permission.
3.4 Account Termination
Vocal Nest reserves the right to suspend or terminate accounts that violate these terms, with or without prior notice. If your account is terminated, you will lose access to all associated data and content. We are not liable for any loss resulting from account termination due to a breach of these terms.
3.5 Limitation of Liability
To the maximum extent permitted by the New Zealand Consumer Guarantees Act 1993 and other applicable legislation:
- Vocal Nest is provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
- We are not liable for any indirect, incidental, special, or consequential loss or damages arising from your use of or inability to use the platform.
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those rights cannot lawfully be excluded.
3.6 Governing Law
These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
4. Changes to This Policy
We may update these policies from time to time to reflect changes in the law, our business practices, or the services we provide. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are significant, we will take reasonable steps to notify you directly. We encourage you to review this page periodically to stay informed.
