This Privacy Policy explains how Vocal Nest, operated by Park Creative ("we", "us", "our"), collects, uses, stores, and discloses personal information. It has been prepared in accordance with the New Zealand Privacy Act 2020 and the Information Privacy Principles contained within it.
By using Vocal Nest, you agree to the collection and use of personal information as described in this policy.
1. Who We Are
Vocal Nest is operated by Park Creative, a New Zealand business. We are the agency responsible for collecting and holding your personal information as described in this policy.

2. Information We Collect
We collect personal information only where it is reasonably necessary to provide and improve our services. We collect information directly from you in most cases. In some circumstances, technical data (such as device type and browser) may be collected automatically when you access the platform.

3. How We Use Your Information
Your information is used solely for:
- Providing and improving the Vocal Nest service.
- Authenticating your identity and managing your account.
- Sending transactional communications (e.g. invitations, notifications).
- Generating AI-powered video transcriptions for campaign creators.
- Complying with legal obligations under New Zealand law.
We do not sell, rent, or trade your personal information to third parties.
4. Data Sharing
We will not disclose your personal information to any other person or organisation except in the following circumstances:
- With your team members: If you are part of a Flock workspace, your display name and email may be visible to other team members within the same workspace.
- With campaign creators: Respondent data (name, email, job title, and video) is shared directly with the campaign creator who initiated the testimonial request.
- With service providers: We use trusted third-party technology providers to store and process data on our behalf. These providers are contractually required to handle personal information in accordance with the New Zealand Privacy Act 2020 and applicable data protection standards.
- When required by law: We may disclose information if required by a valid legal process, court order, or government request under New Zealand law.
5. Overseas Disclosure
Some of our technology service providers operate outside of New Zealand. As a result, personal information may be stored or processed in overseas data centres. Where this occurs, we take reasonable steps to ensure that your information is protected to a standard comparable to that required under the New Zealand Privacy Act 2020, including by selecting providers who adhere to internationally recognised security and privacy standards.
6. Data Security
We take all reasonable steps to protect your personal information from loss, misuse, unauthorised access, modification, or disclosure:
- All data is transmitted using TLS/SSL encryption.
- Video files and all personal data are stored with server-side encryption at rest.
- Access to personal information is restricted to authorised personnel only, through strict role-based access controls enforced at both the application and infrastructure levels.
- Security practices are reviewed regularly to ensure they remain effective.
7. Your Rights Under the New Zealand Privacy Act 2020
Under the Privacy Act 2020, you have the following rights:
- Right to Access: You may request a copy of the personal information we hold about you. We will respond within 20 working days as required by law.
- Right to Correction: If you believe any information we hold about you is inaccurate, incomplete, or misleading, you may request that it be corrected.
- Right to Request Deletion: You may request that we delete your personal information, subject to any overriding legal obligations we may have to retain it.
- Right to Withdraw Consent: You may withdraw consent for data processing at any time. Withdrawing consent may affect your ability to use certain features of the service.
- Right to Complain: If you believe we have breached the Privacy Act 2020, you have the right to make a complaint to the Office of the Privacy Commissioner at www.privacy.org.nz.

8. Data Retention
We retain personal information only for as long as it is needed to fulfil the purpose for which it was collected, or as required by law. When personal information is no longer required, we take reasonable steps to destroy or de-identify it securely.
- Campaign videos are removed within 30 days of a campaign being deleted.
- Account data is retained for the duration of your account and for a reasonable period after closure to meet any legal obligations.
9. Cookies & Analytics
Vocal Nest uses minimal cookies for essential functionality:
- Session cookies: To maintain your authentication state while you are logged in.
- Preference cookies: To store your display preferences (e.g. light/dark mode).
We do not use any third-party tracking cookies or advertising trackers.
10. Children's Privacy
Vocal Nest is not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal data, please contact us immediately at hello@parkcreative.nz and we will take appropriate steps to delete that information.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in the law, our business practices, or the services we provide. When we do, we will revise the "Last updated" date at the top of this page. Where changes are significant, we will take reasonable steps to notify you directly. We encourage you to review this page periodically.
